Criminal Original Petition filed under Section 482 of the Code of Criminal Procedure, to call for the records and set aside the order dated 09.11.2022 passed in Crl.M.P.No.1078 of 2021 in STC.No.785 of 2019 by the learned Judicial Magistrate, Fast Track Court, Poonamallee and direct payment of interim compensation of Rs.18,00,000/-.

ORDER

This criminal original petition has been filed challenging the order passed by the Court below dismissing the application filed by the petitioner under Section 143A(1) of the Negotiable Instruments Act to direct the respondent to pay 20% of the cheque amount as interim compensation.

2. This Court carefully considered the submissions made by the learned counsel for the petitioner and perused the materials available on record.

3. On going through the records, this Court finds that the STC is pending from the year 2019 onwards. If this petition is entertained and notice is ordered to the respondent and the proceedings are stayed, this petition will not see the light of the day and the proceedings will be pending for years together. Therefore, considering the fact that the complaint is pending for the last 4 years, this Court deems it fit not to go into the merits of the order passed by the Court below and rather this Court directs the learned Fast Track Magistrate, Poonamallee to dispose of STC No.785 of 2019 within a period of 3 months from the date of receipt of copy of this order and the complaince report shall be filed before this Court.
