Today, the matter is listed under the caption "for Clarification", at the instance of the learned counsel for the petitioner / accused person. 2.

This petition has been filed by the petitioner to clarify the order passed by this Court in Crl.O.P.No.6152 of 2023 dated 21.03.2023.

3. The learned counsel for the petitioner submitted that this Court dismissed bail petition in Crl.O.P.No.6152 of 2023, on 21.03.2023, with a direction to the trial Court to complete the trial within a period of two months from the date of the receipt of the copy of the order. After dismissal of the bail petition, the petitioner has preferred a Criminal Revision before this Court, challenging the dismissal of Statutory bail before the trial Court . The Revision filed by the petitioner was allowed and the petitioner was Page No.1/4

released on bail in Crl.R.C.No.671 of 2023, vide order dated 20.04.2023. He further submitted that the case before the trial Court is now posted for trial and the petitioner has also sought for crucial document to be produced before the Court for establishing his defence and the same is pending. While this being the case, the trial Court is proceeding with the case in a very hurried manner without giving any breathing time to the petitioner to properly conduct the case. Hence the petitioner requests the trial Court not to proceed with the trial in such a hasty manner, and the trial Court is pointing out the direction issued by this Court and the petitioner is being told that unless this Court modifies the direction, the Trial Court could not proceed in any other manner.

As per the submission of the learned counsel for the petitioner, the learned trial Judge wants to clarify the time limit given by this Court accordingly it is clarified that said time limit was given, since the accused was in jail. Now he was released on bail so the learned trial Judge is directed to proceed with the trial, at reasonable time being given to other side, in a Page No.2/4

manner known to law.

5. With the above direction, this Criminal Miscellaneous petition is allowed.
