The petitioners, who apprehends arrest at the hands of the respondent police for the offence punishable under Sections 147, 294(b), 323, 324, 506(2) of I.P.C in Crime No.205 of 2023 on the file of the respondent police, seeks anticipatory bail.
2.The case of the prosecution is that on 30.05.2023, the temple was held in the village of the de-facto complainant. While so, the 1st petitioner splashed the turmeric water on Shanthi who is the elder brother's wife of defacto complainant and the same was questioned by her husband. The 1st petitioner attacked Kamalakannan and his wife by using iron rod on kamalakannan's jaw. The 1st petitioner also attacked the de-facto complainant and his brother. While so, the nephew was intervening in the quarrel, the 2nd petitioner attacked him by using a wooden log. The 3rd accused also attacked the de-facto complainant's brother. The accused 4&5 abused the de-facto complainant and his relationship with dire consequence. Hence the case.
3.The learned counsel for the petitioner submitted that the petitioners are innocent persons and they have been falsely implicated in this case. Hence, he prayed for grant of anticipatory bail to the petitioners. https://www.mhc.tn.gov.in/judis 1/2

nvi 4.Learned Government Advocate (Crl.Side) appearing for the respondent police would submit that the petitioners attacked the de-facto complainant and his brother and threatened him. 2 persons sustained injury which is grievous in nature and 3 persons sustained simple injury. However, he opposed for grant of anticipatory bail to the petitioner. 5.Heard the learned Counsel for the petitioner and the learned Government Advocate (crl.side) and perused the materials available on record.
6.Taking into consideration the facts and circumstances of the case, the submissions made by the learned counsel on either side and the injury is grievous in nature, this Court is not inclined to grant anticipatory bail to the petitioners.
