ORDER : The Court Made the following order :- (The case has been heard through video conference) The petitioner, who was arrested and remanded to judicial custody on 26.10.2021 for the offence under Sections 174 (3) Cr.P.C. @ into Section 306 IPC, in Crime No.778 of 2021, seeks bail. 2.The case of the prosecution is that the petitioner in a drunken mood has demanded a sum of Rs.3 lakhs from his wife to start a Grocery shop following which, there was a quarrel between them and in a fit of rage, the petitioner's wife poured Kerosene and set fire herself and died.

3.The learned counsel appearing for the petitioner would submit that the petitioner has not committed any offence as alleged by the prosecution and he has been falsely implicated in this case and that https://hcservices.ecourts.gov.in/hcservices/

the petitioner has been suffering incarceration for about 30 days from 26.10.2021. He would further submit that the petitioner has got a 3 year old female child and a 9 months old male child and now they living without parental care and hence, he prays for grant of bail to the petitioner.

4.The learned Government Advocate raised strong objection stating that the petitioner in a drunken mood has demanded a sum of Rs.3 lakhs from his wife to start a Grocery shop following which, there was a quarrel between them due to which, the petitioner's wife poured Kerosene and set fire herself and died.

5. On seeing the grave allegation levelled against the petitioner and that the investigation has not been completed, this Court is not inclined to grant bail to the petitioner. Accordingly, this Criminal Original Petition is dismissed.
