ORDER

The petitioners, who apprehend arrest at the hands of the respondent police for the offences punishable under Section 318(4) of BNS, (420 IPC) in Crime No.459 of 2024, on the file of the respondent Police, seeks anticipatory bail.

2. The petitioners received a sum of Rs.1,64,000/- from the defacto complainant as a chit amount and failed to repay the amount. The defacto complainant joined the chit conducted by the petitioners herein and after the period is over, the petitioners failed to repay Rs.1,64,000/-. Hence, the complaint.

3. The learned counsel for the petitioners submitted that the defacto complainant's son had borrowed a money from the petitioners herein and failed to repay the same. Hence, they were unable to settle the victim.

4. The learned Government Advocate (Crl.Side) for the respondent 2/4

police reported that the victim is a old lady, for the purpose of giving treatment to the defacto complainant's husband, who is suffering from kidney disease and she joined with the chit. Due to non payment, she suffered loss and come forward with the complaint.

5. Considering the fact that the petitioners have conducted chit and failed to repay the amount to victim lady, this Court is not inclined to grant bail to the petitioners.
