Advocate ( Crl. Side) PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C. ORDER : The Court Made the following order :- The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 417, 376, 294(b) and 506(i) of IPC, in Crime No.13 of 2021, seeks anticipatory bail.
2.The case of the prosecution is that the petitioner and the defacto complainant had a love affair and they used to go to several places and were also having physical relationship. But, the petitioner refused to marry the de facto complainant. The petitioner misusing the relationship, gave torture to the defacto complainant. Hence, the law enforcing agency registered a case as against the petitioner. 3.The learned counsel for the petitioner submitted that the petitioner and the defacto complainant are relatives and loved each other and due to ill advice of the parents only, this complaint was lodged by the defacto complainant before the respondent police. He would further state that the petitioner has nothing to do with the alleged offence and he has been falsely implicated in this case.
4. The learned Government Advocate submitted that the https://hcservices.ecourts.gov.in/hcservices/
investigation is at earlier stage. Hence, he opposed to grant anticipatory bail to the petitioner.
5. Considering the above fact and circumstances of the case and the nature of allegations against the petitioner, this Court is not inclined to grant anticipatory bail to the petitioner.
