In a proposed suit for alleged trademark infringement and passing off, the intending plaintiff has presented this application for leave to sue. Although the respondents have their registered offices outside the jurisdiction of this Court, it is submitted that the mobile wallet of the respondents, which forms the subject of the suit, was registered at Chennai and that payments are being made from Chennai as disclosed by the documents at pages 339 and 346 of the typed set of papers.

2. Upon taking the above into account and on examining the draft plaint, it is evident that the cause of action has arisen at least partly within the jurisdiction of this Court. Accordingly, this application is allowed by granting leave to the applicant to institute the suit against the respondents before this Court. As a corollary, the Registry is directed to number the suit, if it is otherwise in order.
