Prayer: Writ Petition filed under Article 226 of the Constitution of India for issuance of a Writ of Mandamus directing the 3rd Respondent to forward the application dated 22.05.2020 having number 704011 of the petitioner who has secured 48 marks in the written examination conducted by the 3rd respondent for the post of Assistant Surgeon (General) and secured MRB Rank No.4000 to the 2nd Respondent to enable the 2nd Respondent to issue appointment order to the petitioner as Assistant Surgeon (General) in any of the Public Health Centres in Karur District in the Government College and Hospital, Karur within a time frame to be fixed by this Hon'ble Court. ORDER

This writ petition has been filed for direction to the 3rd respondent to forward the application of the petitioner dated 22.05.2020 for the post of Assistant Surgeon (General) to enable the 2nd respondent to issue appointment order to the post of Assistant Surgeon (General) in any of the Public Health Centres.

2. The petitioner is qualified with MBBS Degree and applied for the post of Assistant Surgeon (General) as per notification dated 25.09.2018. The petitioner applied for the said post and the 3rd respondent called upon the petitioner for certificate verification. However, the petitioner was unable to attend the certificate verification scheduled on 27.12.2020. Meanwhile, the 3rd respondent released the list of candidates for appointment to the post of Assistant Surgeon on 31.12.2020. However, she went to the office of the 3rd respondent and signed the declaration form and completed the verification process. However, the 2nd respondent informed that the 3rd respondent did not forward her application for issuance of appointment order.

3. The learned counsel for the 3rd respondent would submit that by communication dated 14.07.2021 itself forwarded the candidates including the petitioner for consideration to the post of Assistant Surgeon (General). 3/6

On perusal of the communication dated 14.07.2021 revealed that at the time of certificate verification for selection of Assistant Surgeon (General) 2018 four candidates including the petitioner have not submitted certain mandatory documents. Therefore, their provisional selection was withheld. Thereafter, the candidates have furnished their required documents and their documents have been verified subsequent to the production of the documents. Thereafter, the candidates including the petitioner MRB Rank No.4000 application No.704011 examination No.302391 was forwarded to the 2nd respondent and directed the 2nd respondent forward the copy of appointment and posting order to the office of the 3rd respondent by communication dated 14.07.2021 itself. However, the 2nd respondent did not issue any order of appointment to the petitioner so far.

5. In view of the above facts and circumstances, 2nd respondent is directed to issue appointment order to the petitioner to the post of Assistant Surgeon (General) in any of the Public Health Centres forthwith and send copy of the same to the 3rd respondent.
