Mrs.R.Sreevidhya, learned counsel takes notice for the 10th respondent.

2. Since the Insurance Company is not challenging the liability and the appeal is focusing only on the negligence and quantum, we deem it fit to dispense with notice to the respondents 6 to 9, who are the owners of the vehicles involved in the accident.

3. Accepting the reasons assigned in the affidavit filed in support of the petition, this petition is ordered and the delay of 53 days in preferring the above appeal is condoned.

4. Registry is directed to number the appeal and post the same along with CMA.No.1980 of 2023 on 29.11.2023.
