Petition praying that in the circumstances stated therein the High Court will be pleased to relax the condition (b) i.e., the petitioner shall report before the Trial Court daily at 10.30 am pending disposal of the appeal imposed by this Honourable Court in the order dated 04.12.2018 made in Crl.M.P.No.16211 of 2018 in Crl.A.No.780 of 2017.

Order : This petition coming on for orders upon perusing the petition and upon hearing the arguments of M/S.MANSOOR ILLAHI, Advocate for the petitioner and of THE PUBLIC PROSECUTOR on behalf of the Respondent the court made the following order:- This is a petition to relax the bail condition, imposed by this Court, by order dated 04.12.2018 in Crl.M.P.No.16211 of 2018 in Crl.A.No.780 of 2017.

2. The petitioner was convicted and sentenced, by judgment dated 25.07.2017 in Spl.C.C.No.32 of 2015 on the file of the Sessions Court (Mahila Court), Coimbatore, challenging which, the petitioner is before this Court.

3. This Court, by order dated 04.12.2018 in Crl.M.P.No.16211 of 2018 in Crl.A.No.780 of 2017, suspended the sentence and granted bail to the petitioner on several conditions, one of which is that the petitioner shall report before the Trial Court daily at 10.30 a.m. The present petition has been filed seeking relaxation of the aforesaid condition.

4. On instructions, the learned Government Advocate (Crl. Side) submitted that the petitioner has been complying with the said condition from the date of his release.

5. In view of the above, the aforesaid condition is relaxed. However, the petitioner shall appear before the Trial Court, at 10.30 a.m., on the first working day of every month until the disposal of the appeal and if he is not able to appear before the trial Court on any day, he shall make arrangements to file an application under Section 317 Cr.P.C. and shall appear before the trial Court on any other day in lieu of the date of his absence, as directed by the trial Court.
