This civil miscellaneous petition has been filed by the petitioner / appellant to accept the cause title in respect of the name of the fourth respondent as Mrs.B.Thilagavathy Ammal (died), instead of Mrs.B.Thilagavathy Ammal, in the Original Side Appeal.

2.Heard the learned counsel for the petitioner / appellant, who submitted that subsequent to the judgment dated 04.02.2022 passed in CS.No.679 of 2001, the fourth respondent died on 29.05.2022 leaving behind the respondents 1 to 3 and 5 as her legal heirs to succeed her estate. As such, the appellant has referred the fourth respondent as Mrs.B.Thilagavathy Ammal (died) in the cause title of the original side appeal, which is differing from the cause title of the civil suit. Therefore, this miscellaneous petition. 3.Considering the reasons stated in the affidavit filed in support of this petition and being satisfied with the same, this petition is ordered as prayed for. https://www.mhc.tn.gov.in/judis
