ORDER

This Contempt Petition is filed seeking to punish the Respondent for willfully disobeying and violating the orders of this Court in Crl.O.P.No.491 of 2022 dated 12.07.2022.

2.The petitioner originally filed Crl.O.P.No.491 of 2022 seeking to include the driver of the bus as an accused by altering the FIR in Crime No.285 of 2021 instead of the petitioner himself. While rejecting his claim, this Court has directed the Investigating Officer to take up the investigation, collect all the materials and proceed as per law and if the investigation officer finds from the materials that the petitioner is not the offender, investigation officer may proceed against the persons against whom the materials all collected. Now, the grievance of the petitioner is that still he is made as an accused and has not been removed from the rank of accused. Therefore, according to him, the act of the respondent amounts to contempt.

3.At the outset, this Court is of the view that the very filing of the

Contempt Petition is not proper. This Court had only directed the investigating officer to conduct the investigation and only on finding that the petitioner is not the offender, to proceed against the other persons. Whereas, on the basis of the investigation, it is found that the petitioner is an accused and the final report is also filed in C.C.No.715 of 2025 and the matter is posted on 08.12.2025 for the appearance of the petitioner before the concerned Magisterial Court. 4.In such view of the matter, I do not find any merit in this Contempt Petition. Accordingly, the Contempt Petition is closed.
