Advocate ( Crl. Side) PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C. ORDER : The Court Made the following order :- The petitioner, who apprehends arrest for the alleged offence under Sections 376 and 417 of IPC, in Crime No.18 of 2021, seeks anticipatory bail.

2.The case of the prosecution is that the defacto complainant lodged a complaint against the petitioner before the respondent police by stating that the petitioner gave a false promise to marry her and had a sexual intercourse with her. Subsequently, he refused to marry her and he also cheated a sum of Rs.1,00,000/- from the defacto complainant. Hence, the complaint.

3.The learned counsel appearing for the petitioner submits that the defacto complainant lodged a false case against the petitioner and his family members and he further submits that petitioner has not committed any such offence as alleged by the prosecution and he has been falsely implicated in this case. Hence prays to grant anticipatory bail to the petitioner.

4.The learned Government Advocate (Crl.Side) submits that the investigation is still pending and it needs detailed enquiry. Hence, he opposed to grant anticipatory bail to the petitioner. https://hcservices.ecourts.gov.in/hcservices/

5. Considering the facts and circumstances of the case and also the fact that investigation is still pending and it needs detailed enquiry, this court is not inclined to grant anticipatory bail to the petitioner.
