ORDER

(Order of the Court was made by J.NISHA BANU, J.) This Writ Petition is filed for a Mandamus directing the 2nd respondent to issue the Origin cum Caste Certificate in proper format that the petitioner belongs to Jambuvulu (SC) community of Puducherry Origin based upon the Nationality Certificate / Caste Certificate / Residence Certificate / Income Certificate already issued by the 2nd respondent in Certificate No.PY/TOY/01/0005161 dated 18.05.2008.

It is the case of the petitioner that she belongs to "Jambuvulu" Community which is classified as Scheduled Caste under the Constitution (Pondicherry) Scheduled Castes Order, 1964 and she obtained the Community Certificate from the 2nd respondent on 18.05.2008 stating that she belong to Jambuvulu (SC) community. Whileso, the petitioner applied for the post of Guest Trained Graduate Teacher in pursuant to the notification issued by the Deputy Director, Directorate of School Education on 05.07.2019 and in the selection process, the petitioner was called upon to produce the fresh nativity certificate and fresh community certificate. The petitioner approached the second respondent and obtained the fresh community and nativity certificate on 31.10.2021. Since no action was taken, the petitioner filed O.A.No.1004 of 2024 before the Central Administrative Tribunal and vide order dated 06.08.2024, the Tribunal directed the competent authority to dispose of the

representation dated 27.12.2021 within two months from the date of receipt of a copy of this order. Thereafter, the Deputy Director of School Education passed an order dated 07.10.2024 stating that the petitioner is not eligible since she has not submitted fresh Puducherry Origin cum Caste Certificate. Therefore, the petitioner preferred an application to the 2 nd respondent on 23.01.2025 requesting to issue fresh Origin cum Caste Certificate, however till date, no action was taken on the petitioner's application and hence the petitioner has come up with the present writ petition.

3. The learned counsel for the petitioner submitted that the mother of the petitioner was already issued with the "Jambuvulu" SC community certificate and therefore, there is no legal impediment for the second respondent to issue the community certificate in favour of the petitioner also.

The learned Additional Government Pleader (Pondy) appearing for the respondents submits that if the petitioner immediately applies to the second respondent for issuance of fresh Puducherry Origin cum Caste Certificate, the application would be considered by the respondents as expeditiously as possible.

5. Heard the learned counsel for the parties and perused the materials available on record.

6. The undisputed fact remains that the mother of the petitioner is a single parent and she already possess "Jambuvulu" SC community certificate. The petitioner has not been issued with the said community certificate, though she has submitted the application as early as on 23.01.2025. The learned Additional Government Pleader (Puducherry) also did not raise any serious objection or legal impediment in issuing the community certificate in favour of the petitioner.

In such circumstances, this Court directs the respondents to issue the Jambuvulu (SC) Community Certificate of Puducherry Origin to the petitioner, based on the community certificate of the petitioner's mother, as expeditiously as possible, within a period of four (4) weeks from the date of receipt of a copy of this order. In the meanwhile, the Vigilance Committee shall also file their report to the first respondent as expeditiously as possible, so as to enable the respondents to issue the community certificate to the petitioner as directed above.
