The Petitioner who apprehends arrest at the hands of the respondent police for the offence punishable under Section 436 of IPC in Crime No.188 of 2023 seeks anticipatory bail.

2.The case of the prosecution is that on 17.06.2023, when the Defacto Complainant was in his house, at about 08.15 pm, on hearing the noise of her tenants viz., Anandhi and Sivaraj, she and his brother came out from the house. At that time, the office of Sikkandaar was on fire and the Defacto Complainant with the help of others extinguished the fire. Thereafter, it was came to know that the accused persons came to the place of occurrence and set fire and they tried to break the CCTV camera, which was in front of the said office and fled away. Hence the complaint.

3.The learned Counsel for the Petitioner would submit that A1 was arrested and remanded to judicial custody and subsequently in Crl.OP.No.17032 of 2023 dated 01.08.2023 this Court has granted bail to him. Hence, the learned counsel for the Petitioner prays for grant of anticipatory bail to the Petitioner.

4.The learned Government Advocate (Crl. Side) for the Respondent would submit that the Petitioner had tried to break open the CCTV camera and 1/ 3

set the building on fire, due to the money transaction between the Petitioner and Defacto Complainant. He vehemently opposed to grant anticipatory bail to the Petitioner.

5.Heard both sides and perused the materials available on record. 6.Taking into consideration the facts and circumstances of the case and also the submissions made by the learned counsel on either side and the overtact attributed to the Petitioner, I am not inclined to grant anticipatory bail to the Petitioner.
