Prayer: Writ Petition filed under Article 226 of the Constitution of India for issuance of a Writ of Mandamus, directing the respondent herein to forthwith permit the petitioner to pay necessary fees for grant of spare bus permit and receive the petitioner's application on file and consider and pass orders on merits on the petitioner's application for grant of spare mini bus permit. The petitioner has come up with this writ petition seeking a direction to the respondent to receive the petitioner's application and permit the petitioner to pay necessary fees for grant of spare bus permit and pass necessary order on merits.

2.It is the case of the petitioner that he is a Stage Carriage Operator having mini bus bearing Registration No. TN-23 AB 8561, operating on the route "Tirukoilur Bus Stand to Ammankollaimedu Ration Shop". Since there is every possibility of breakdown of the mini bus and time interval for renewal of fitness certificate etc., the petitioner wanted to apply for spare bus permit before the respondent. When the petitioner approached the respondent with an application for spare bus permit, the respondent refused to accept the same and the petitioner was also not allowed to pay the prescribed fees. Therefore, the petitioner has come before this Court by way of this writ petition. 2/4

3.Mr.N.Naveen Kumar, learned Government Advocate taking notice for the respondent, on instructions submits that the respondent has not received any application from the petitioner for spare bus permit so far. 4.In view of the averment made by the petitioner in the affidavit as if the respondent refused to receive the petitioner's application, the petitioner is directed to appear before the respondent on 18.08.2023 and submit necessary application for spare bus permit in a prescribed format with necessary fees. On submission of the said application, the respondent is directed to consider the same and pass final orders on merits and in accordance with law within a period of two weeks from the date of submission of the application. 5.With the above direction, the writ petition stands disposed of. No costs.
