This application has been filed to condone the delay of 219 days in filing a petition to restore the Original Petition in O.P.No.318 of 2002 which was dismissed for want of prosecution.

2. The learned counsel appearing for the applicant submitted that as the erstwhile counsel appearing for the applicant has not appeared, the Original Petition has been dismissed and the applicant came to know about the dismissal of the petition only on 06.08.2022 and the delay is neither wilful nor wanton.

3. Considering the averments made in the affidavit filed along with the application and in order to give an opportunity to the applicant to prosecute the case, this application Ordered.

4. Notice to the respondents returnable by 29.01.2024. Private notice is also permitted.
