Prayer:- Petition filed under Article 226 of the Constitution of India praying to grant Writ of Mandamus or any other writ or order in the nature of Writ directing the respondents to consider the appeal dated 20.10.2009 in the file No.XK:(A4) 7202/09 pending on the file of the first respondent and pass appropriate orders.

O R D E R

The prayer in the writ petition is for Writ of Mandamus directing the respondents to consider the appeal dated 20.10.2009 in file No.XK:(A4) 7202/09 pending on the file of the first respondent and pass appropriate order therein.

2. Heard both sides.

3. The petitioner preferred appeal to the first respondent as against the order passed by the second respondent dated 07.09.2009 regarding issuance of patta. The said appeal according to the learned counsel for the petitioner is still pending with the first respondent and has not been decided so far.

4. In view of the same, there shall be a direction to the first respondent to hear the appeal and decide the same, as https://hcservices.ecourts.gov.in/hcservices/

early as possible, within a period of eight weeks from the date of receipt of a copy of this order and a reasoned order shall be passed by the first respondent after hearing the parties concerned, on merits and in accordance with law.

5. With these directions the writ petition is disposed of. No costs.
