Petition praying that in the circumstances stated therein the High Court will be pleased to relax the conditional order dated 13.10.2017 imposed on the petitioner in Crl.M.P.No.12863/2017 in C.A.No.422/2017 condition that the petitioner shall appear before the learned XI Additional Special Judge, CBI Cases relating to Banks and Financial Institutions, Chennai on first working day of every month at 10.30 a.m. until further orders Order : This petition coming on for orders upon perusing the petition and upon hearing the arguments of M/S.P.KRISHNAN, Advocate for the petitioner and of MR.K.SRINIVASAN SPECIAL PUBLIC PROSECUTOR FOR CBI CASES on behalf of the Respondent the court made the following order:- The criminal miscellaneous petition is filed seeking to relax the conditional order imposed by this Court on the petitioner/appellant vide order dated 13.10.2017 made in Crl.MP.No.12863/2017 in Crl.A.No.422/2017.

This Court, in its order dated 13.10.2017, had suspended the sentence imposed on the petitioner with a direction to report before the Trial Court at 10.30 a.m., on the first working day of every month until further orders.

The learned counsel for the petitioner would submit that the petitioner is a lady coming from Keelavanam Village, Arakkonam Taluk, Vellore District and without the assistance of a male member she finds it difficult to come to Chennai and thereby, would seek that the condition of appearing before the Trial Court on the first working day of every month, be modified.

Heard the learned Additional Public Prosecutor who would submit that the petitioner is complying with the condition regularly. https://hcservices.ecourts.gov.in/hcservices/

This Court also perused the affidavit filed in support of the miscellaneous petition.

Taking into consideration, the averments made in the affidavit, the condition imposed vide order dated 13.10.2017, is hereby modified and the petitioner shall appear before the Trial Court on 03.09.2019 at 10.30 a.m., and thereafter once in four months commencing from January 2020, on the first working day at 10.30 a.m, of the particular month pending Appeal.

The petition is ordered accordingly.
