C.M.P.No.18180 of 2019 in O.S.A.No.13 of 2014 R.SUBBIAH, J and KRISHNAN RAMASAMY, J (The Order of the Court was made by R.Subbiah, J) This Civil Miscellaneous Petition (C.M.P) is filed to modify the judgment and decree dated 20.03.2019 made in O.S.A.No.13 of 2014, in fixing the date to pay the sale consideration of Rs.40 lakhs with interest at 24% p.a. from the date of plaint within six months from this date.

2. Heard both sides and perused the materials available on record.

3. This Court, by judgment dated 20.03.2019 in O.S.A.No.13 of 2014, in paragraph 26, directed the defendants to refund the sum of Rs.40 lakhs received from the plaintiff with interest at the rate of 24% per annum from the date of plaint till realisation.

4. The learned counsel for the petitioner/plaintiff made a request before this Court to fix the time frame for payment of Rs.40 lakhs by the defendants, as directed in the abovesaid judgment dated 20.03.2019.

5. In view of the above request made by the learned counsel for the petitioner/plaintiff, this Court directs the respondents/defendants to pay Rs.40 lakhs with interest at the rate of 24% per annum from the date of plaint till realisation and the said payment shall be made within a period of eight weeks Page No.1/3

from the date of receipt of a copy of this order by the defendants. This C.M.P. is ordered accordingly.
