The petitioner herein seeks a direction to respondents to measure the land in Survey No.624B/13 with an extent of 3 cents situated at Madhepalli Village, Bargur Taluk, Krishnagiri District and rectify the defect in the patta and FMB.
2. According to the petitioner, he purchased 3 cents of land in the above mentioned survey number under sale deed dated 11.01.2001. Thereafter, the land was sub-divided and new sub-division number was assigned as Survey No.624B/13. At the time of sub-division, the extent of land was mentioned as 21⁄2 cents instead of 3 cents purchased by the petitioner. Therefore, he submitted a representation on 20.05.2024 seeking survey of the land purchased by the petitioner and rectification of the defect in the patta and FMB with regard to the extent of the property. The said representation has not been considered. Hence, he is before this Court.
3. The learned Special Government Pleader, who is taking notice for the 1st and 2nd respondents, submitted that if the petitioner submits a fresh online application for survey of the land by paying necessary charges, his request will 2/4
be considered on its' own merits within a time fixed by this Court.
4. In view of the same, without going into the merits of the claim made by the petitioner, the petitioner is directed to submit a fresh online application to survey the land purchased by him. The petitioner shall also pay necessary charges for survey of the land. The 2nd respondent is directed to consider the fresh application to be submitted by the petitioner and pass final orders on its' own merits within a period of eight weeks from the date of receipt of online application after issuing necessary notice to interested parties.
