ORDER

The Criminal Miscellaneous Petition has been filed to modify the condition imposed in Crl.MP.No.13319 of 2022 by this Court dated 09.06.2022 instead of one of the surety shall be parents or blood relatives or family members of the petitioner.

2. Heard, the learned counsel appearing on either side.

3. It is seen that the petitioner was granted statutory bail by the learned V Metropolitan Magistrate, Egmore in Crl.MP.No.13484 of 2022 dated 27.05.2022 in crime No.149 of 2022 on the file of the respondent police. While granting bail, the petitioner was imposed with certain conditions, one of which was to deposit Rs.2,00,000/- into the Court. Thereafter, the petitioner filed a criminal original petition in Crl.OP.No.13319 of 2022 before this Court seeking to set aside the above depositing condition. This Court also ordered that the said condition shall stand deleted by order dated 09.06.2022. Again, the petitioner has now approached this Court to modify the condition

imposed by the learned V Metropolitan Magistrate, Egmore with regard to surety as he could not execute blood surety.

4. Considering the case of the petitioner, this Court is inclined to modify the condition of execution of surety. As such, the same is modified to the effect that "the petitioner will execute a bond by himself along with two solvent sureties for Rs.10,000/- (Rupees Ten Thousand only) instead of "the petitioner will execute a bond by himself along with two solvent sureties for Rs.10,000/- (Rupees Ten Thousand only) and one of the surety shall be parents or blood relatives or family members of the petitioner".

5. Accordingly, this miscellaneous petition is ordered. 13.09.2023 lok
