Crl.O.P.No.22533 of 2021 in Crl.A.SR.No.38070 of 2021 A.D.JAGADISH CHANDIRA, J., Learned counsel for the appellant would submit that the petitioner/appellant is the complainant. He would further submit that the accused had admitted his signature in the cheque and that there is no reply notice to the notice issued by the petitioner. The trial Court ignoring the statutory provisions regarding presumptions, had acquitted the accused on the basis of assumptions.

2. Having heard the counsel and perused the materials available on record, this Court is of the opinion that a prima facie case is made out for grant of leave.
