ORDER
(1)Mrs.C.Meera Arumugam, learned Additional Government Pleader accepts notice on behalf of the respondents 1 to 3 and 5. Mr.D.Gopal, learned counsel accepts notice on behalf of the 4 th respondent. With the consent of the learned counsels on either side, the main writ petition itself is taken up for final disposal at the admission state itself.
(2)The writ petition is filed for a mandamus directing the respondents to take necessary action to form a pathway/road through Anupperi Lakeside for connecting Kollai Medu residents and Kukkalapalli village, B.N.Palayam village and K.V.Kuppam etc, by considering the representation of the petitioner dated 01.06.2025.
(3)The petitioner is an agriculturist owning agricultural lands in S.Nos.262/3B and 264/2A1A3 of B.N.Palayam Revenue Village, K.V.Kuppam Taluk, Vellore District. The petitioner as well as the adjacent agriculturists were residing in their respective lands by constructing houses. The petitioner states that there is a lake namelyAnupperi lake in S.No.259 of B.N.Palayam village and the residents of Kollaimedu area were using the lake bund of the said Lake as their pathway to reach the adjacent villages. Pursuant to the petitioner's representation, the Block Development Officer, Gudiyatham, on 17.05.2024, assured the petitioner that a pathway would be provided. Even the District Collector, Vellore District, instructed the authorities to take action on the petitioner's representation. Despite the District Collector's instructions, no action was taken and therefore, the petitioner submitted a
representation on 01.06.2025. Even then, no action was taken. Hence, the petitioner filed the above writ petition for the aforesaid relief. (4)Learned counsel for the petitioner submits that it would suffice if a direction is issued to the 4 th respondent to consider and pass orders on the petitioner's representation dated 01.06.2025 within a time frame to be fixed by this Court. (5)Heard the learned counsels on either side and also perused the materials placed on record.
(6)Under the facts and circumstances of the case and in view of the limited prayer of the learned counsel for the petitioner, a direction is issued to the 4 th respondent to consider and pass orders on the petitioner's representation dated 01.06.2025 on merits and in accordance with law within a period of six weeks from the date of receipt of a copy of this order.
