, J This Civil Miscellaneous Petition has been filed seeking to condone the delay of 114 days in filing the Civil Miscellaneous Appeal.

2. Heard Mr.M. Murali Vinod, learned counsel appearing for the petitioner Tamilnadu State Transport Corporation, Coimbatore.

3. Since the fourth and fifth respondents remained absent in the Tribunal and were set ex parte, issuance of notice to them is dispensed with.

4. Ms.S. Kiruthika, learned counsel appearing for the respondents 1 to 3 did not raise any serious objection in allowing this petition.

5.Having satisfied with the reasons assigned in the affidavit filed in support of this petition, the miscellaneous petition is allowed and the delay of 114 days in filing the above appeal is condoned.
