Learned counsel for plaintiff points out that such an application cannot be entertained in the light of proviso to Order VIII Rule 1 of 'amended Code of Civil Procedure, 1908' [hereinafter 'amended CPC' for the sake of brevity and convenience] as amended by 'Commercial Courts Act, 2015 (Act 4 of 2016)' [hereinafter 'CCA' for the sake of convenience and clarity]. However, this will be considered in the ensuing listing as Mr.S.N.Amarnath requests for a short accommodation to process the applications and bring it on Board.
