Respondent Prayer: Civil Revision Petition filed under Article 227 of the Constitution of India to direct the Family Court, Mannargudi, Tiruvarur District to take on file and renumber the case in HMOP.No.97 of 2020 which was transferred from Principal Sub Court, Trichy to the Family Court, Mannargudi as per the order of this Corut in Tr.CMP.No.303 of 2023 dated 22.06.2023 and dispose the same within a stipulated period. ORDER

The grievance for which the petitioner has approached this Court is that HMOP.No.97 of 2020, which he had filed before the Subordinate Court at Trichirapalli though transferred by this Court on 22.06.2023 to the file of the Family Court, Mannargudi, has not been renumbered. 1/4

Taking note of the fact that more than one year and four months lapsed from the date of the order, I called for the report from the learned Family Court, Tiruvarur at Mannarkudi as to why the proceedings were still unnumbered. The learned Sessions Judge, Fast Track Mahila Court, Tiruvarur (in Full Additional Charge of Judge, Family Court, Tiruvarur @ Mannargudi) has sent a report on 23.10.2024.

3. The report reveals that HMOP.No.97 of 2020 has been renumbered as HMOP.No.56 of 2024. The report also states that notices were sent to both parties for appearance before the Court. While the respondent/wife entered appearance, the husband had not received the notice. Hence, the matter had been adjourned from 18.10.2024 to 21.12.2024.

4. Since the petitioner has not received the notice and thereby not enabling the court to proceed further with the enquiry, I am inclined to direct the Family Court, Tiruvarur, Mannargudi to dispose of the proceedings within a period of ten months from the date of appearance of the petitioner/husband. The learned Trial Judge will take note of the fact 2/4

that the proceedings were transferred at the stage of trial from the file of the Principal Sub Court, Trichy.

5. With the above directions, this civil revision petition is ordered. No costs.
