C.M.P.No.17958 of 2024 in CMA(TM)/SR.105280/2024 SENTHILKUMAR RAMAMOORTHY,J By this petition, the intending petitioner seeks condonation of the delay of 94 days in filing the appeal. In the affidavit in support of this petition, it is stated that the appellant was hospitalized during the relevant period and, consequently, was unaware of the order of refusal of the trade mark application until the appellant recovered.

2. Mr.A.R.Sakthivel, learned SPC has no serious objection to this petition being allowed.

3. Upon considering the reason set out in the affidavit and being satisfied that sufficient cause is shown, the delay in filing the appeal is condoned. Consequently, the Registry is directed to number the appeal, if otherwise in order.
