ORDER : The Court Made the following order :- The petitioner who apprehends arrest by the respondent police for an offence under Sections 379, 430 of I.P.C r/w Section 21(1) Mines & Minerals (development & Regulation) Act, 1957 in Crime No.532 of 2021, seeks Anticipatory bail.

2. The case of the prosecution is that the petitioner is involved in illegal transportation of one unit of river sand in tractor bearing Regn.no.TN-30-BE-4898.

3. It is seen from records that this is the second Anticipatory bail petition filed by the petitioner. The previous order, dismissing the Criminal Original petition in Crl.O.P.No.16908 of 2021 was passed by this Court on 15.09.2021.

4. The learned Government Advocate (Crl. side) submitted that there is no change in circumstances after the previous order was passed on merits. Hence, the learned Government Advocate vehemently opposed to grant Anticipatory bail to the petitioner. https://hcservices.ecourts.gov.in/hcservices/

In view of the submission made by the learned Government Advocate, no change of circumstances arises for considering the second Anticipatory bail petition. Hence, this Criminal Original petition is dismissed.
