The plaintiff has challenged the election which has already been completed and the election was declared by the fifth defendant who was appointed as Returning Officer of the second defendant Association. Excepting for the fifth defendant, all the defendants are within the jurisdiction of this Court. Hence, the plaintiff has sought for leave to sue the fifth defendant.

2. This Court is satisfied with the reasons stated in the affidavit filed in support of this petition and is inclined to grant leave to sue the fifth defendant as prayed for. Accordingly, A.No.4215 of 2021 is allowed as prayed for.

3. Registry is directed to number the Suit, if it is otherwise in order and list the same.
