Advocate ( Crl. Side) PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C. ORDER : The Court Made the following order :- The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 341, 294(b), 323, 397 and 506(2) of IPC, in Crime No.575 of 2021, seeks anticipatory bail.

2.The case of the prosecution is that the petitioner along with other accused had way laid the defacto complainant and grabbed a sum of Rs.150/- at knife point.

3.The learned counsel for the petitioner would submit that the petitioner did not commit any offence as alleged by the prosecution and he would further submit that the co-accused arrested and enlarged on bail. Hence, he seeks for grant of anticipatory bail to the petitioner. Hence, this complaint.

4.The learned Government Advocate would submit that the investigation is still pending and the petitioner is a habitual offender. Hence, he opposed to grant anticipatory bail to the petitioner.

5.Considering the fact that the petitioner has involved in so many previous cases and also taking note of the fact that the petitioner is a habitual offender, this Court is not inclined to grant anticipatory bail to the petitioner.
