ORDER

[Order of the Court was made by M.M.SUNDRESH, J.] Seeking a direction to the first respondent to produce the petitioner's husband namely Silambarasan, S/o. Ravi, aged about 34 years, before this Court from the illegal custody of the second respondent and set him at liberty, the present habeas corpus petition has been filed. https://hcservices.ecourts.gov.in/hcservices/

2. Today the petitioner and the detenu are present. From the discussion we had with both of them, it appears that the detenu is not in illegal custody but there are other complications involving extra marital affair. Now, both the petitioner and the detenu have agreed to go for mutual divorce. The petitioner is also stated to have filed a petition for divorce and the detenu has informed us he will give consent for divorce. The aforesaid statement made by the detenu stands recorded.

3. The only other question is with respect to the meeting of the children. Even on this issue, it is hereby agreed between the petitioner and the detenu that the detenu shall have the visitation right on every Sunday between 10.00 a.m. and 12.00 noon over the minor children born out of the wedlock.

4. In view of the above, the Habeas Corpus Petition stands disposed of.
