ORDER
Challenging the orders dated 27.06.2023 in M.P.No.354/2023 in M.C.No.239/2020 passed by the I Additional Family Court, Chennai, the present revision is filed. The petitioner filed a petition in M.P.No.354/2023 under Section 5 of the Limitation Act, 1963 praying to condone the delay in filing an application to set aside ex parte order
passed against him in M.C.No.239/2020. The said petition was allowed on 27.06.2021 on payment of cost of Rs.2,000/- which is to paid by the present revision petitioner to the first respondent on or before 13.07.2023. Challenging the said order, the present revision is filed.
2. The learned counsel for the revision petitioner contended that the petition filed under Section 5 of the Limitation Act was dismissed for non payment of costs of Rs.2,000/- and ultimately, the petition itself was dismissed. She did not file a copy of the order passed by the trial Court. It is admitted that the revision petitioner did not file a petition seeking extension of time for payment of costs of Rs.2,000/-. The law will not help the recalcitrant persons and in such circumstances the Criminal Revision Case is dismissed at the admission stage itself. Consequently, connected Criminal Miscellaneous Petition is closed. 22.08.2023 Index: Yes/No Internet: Yes/No Speaking/Non-Speaking order mtl
