2.This Transfer Civil Miscellaneous Petition is filed under Section 24 of the Code of Civil Procedure seeking withdrawal of FCOP No.118 of 2025 from the file of the Family Court at Vellore and transfer the same to the Family Court at Chennai.

3. The marriage between the petitioner and husband was solemnized on 11.12.2020 as per Hindu rites and customs at Mohaln Garden Kalyana Mandapam, Chennai. The husband has filed FCOP No.118 of 2025 before the Family Court, Vellore seeking restitution of conjugal rights

4. The petitioner is the wife. It is stated that she is residing at Chennai with the minor child aged about three years.

5. The respondent/husband has opposed the transfer contending that if the matter is transferred to Chennai, he would also have to travel from Vellore to Chennai.

Having considered the rival submissions, this Court is of the view that in a matrimonial proceeding, the convenience of the wife, particularly when she is stated to be having the custody and care of a minor child of tender age, deserved primacy. The respondent's objection, that he would have to travel, by itself is not a sufficient ground to deny transfer when the balance of convenience otherwise warrants it.

7. Accordingly, Tr.C.M.P. No.682 of 2025 is allowed. FC.O.P. No.118 of 2025 on the file of the Family Court, Vellore, is withdrawn and transferred to the file of the Family Court, Chennai. The Family Court, Vellore, shall transmit the entire records to the Family Court, Chennai, within three (3) weeks from the date of receipt of this order and the Family Court, Chennai shall dispose of the matter in accordance with law, as expeditiously as possible, uninfluenced by any observations made in this order.
