ORDER

This writ petition has been filed, seeking for a direction to the respondents to pass final orders on the petitioner's representation dated 05.08.2024 seeking for refund of the security deposit of Rs.3,07,999/- together with interest, within a time frame to be fixed by this Court. 2.The petitioner has participated in an auction conducted by the respondents and they claim that they have made a security deposit of Rs.3,07,999/- on 26.09.2023 for participating in the said auction. The petitioner also claims that they were the successful bidder in the said auction. However, the materials auctioned by the respondents were not in accordance with the terms and conditions of the sale. Hence, the petitioner 2/6

claims that they did not take the materials. On that ground, they seek for return of the security deposit made by them on 26.09.2023 for a sum of Rs.3,07,999/-. The petitioner has also given a representation on 05.08.2024 seeking for refund of the security deposit amount. Since the representation has not been considered till date, the petitioner has filed this writ petition. 3.Mr.Rajendran Raghavan, learned Senior Panel Counsel and Mr.J.Nalinidhar, learned Junior Panel Counsel accept notice on behalf of the respondents.

4.No prejudice would be caused to the respondents if the petitioner's representation is considered, on merits and in accordance with law, within a time frame to be fixed by this Court.

5.This Court is not expressing any opinion on the merits of the petitioner's representation. It is for the respondents to consider the same, on merits and in accordance with law on the petitioner's representation dated 05.08.2024 seeking for refund of the security deposit amount of Rs.3,07,999/- together with interest, within a period of eight weeks from the 3/6

date of receipt of a copy of this order.

6.Accordingly, this Court directs the respondents to consider the representation of the petitioner dated 05.08.2024 seeking for refund of the security deposit amount of Rs.3,07,999/- together with interest and pass orders, on merits and in accordance with law, within a period of eight weeks from the date of receipt of a copy of this order. 7.With the above said direction, this writ petition is disposed of. No costs.
