ORDER

This Criminal Original Petition is filed to direct the respondent to register the petitioner's complaint dated 11.10.2021 vide C.S.R.No.423 of 2021 immediately and to investigate the same in accordance with law.

2.The contention of the petitioner is that the petitioner had lodged a complaint on 11.10.2021 and C.S.R.No.423 of 2021 assigned. Thereafter, no action has been taken. The grievance of the petitioner is that the petitioner's parent had owned a house property, which was trying to acquire by the petitioner's younger sister and the petitioner's uncle by threatening the petitioner. He is forced to evict from the family property, in which he is now residing along with his children. He further submits that for the same issue, the counter complainant i.e. the petitioner's father viz., S.Noor Mohammed had lodged a complaint against the petitioner and the respondent received the said complaint on 14.10.2021 and the same was registered in https://hcservices.ecourts.gov.in/hcservices/

Crime No.224 of 2021, for the offence under Sections 294(b), 448 and 506(i) IPC.

3.The learned Additional Public Prosecutor submits that the petitioner's complaint has been enquired and closed on 13.10.2021. The petitioner's father viz., S.Noor Mohammed had lodged a complaint and the respondent police found that the complaint makes out a cognizable offence and the FIR came to be registered. Investigation is in progress. The closure of the Complaint in C.S.R.No.423 of 2021 has been intimated to the petitioner and the respondent police also sent a copy of the closure report through registered post. Today, the learned Additional Public Prosecutor produced the copy of the closure report.

4.Considering the rival submissions and on perusal of materials, this Court is not inclined to entertain the petition. The petitioner is at liberty to work out his remedy in the manner known to law.

5.Accordingly, this Criminal Original Petition stands dismissed.
