The criminal miscellaneous petition is filed to condone the delay of 113 days in preferring the above appeal.

The petitioner / appellant is the complainant in a case filed under Section 138 of Negotiable Instruments Act as against the respondent, which was taken on file by the Trial Court in STC No. 1144 of 2018. The Trial Court, by judgment dated 13.02.2024, dismissed the complaint acquitting the respondent as against which the petitioner has preferred the above appeal, however, with a delay of 113 days.

Notice has been served on the respondent and his name is also printed in the cause list.

However, there is no representation on his behalf. In view of the same, this Court construes that there is no serious objection for the respondent t condone the delay.

Accordingly, the delay is condoned and the petition is ordered as prayed for.
