PRAYER : This Second appeal filed under Section 100 of Civil Procedure Code, against the judgment and decree dated 27.04.2022 passed in AS No. 41 of 2020 on the file of the Additional District Judge, Hosur, modifying the judgment and decree dated 27.07.2020 passed in OS No. 20 of 2015 on the file of the Additional Sub Court, Hosur.

JUDGMENT

When the matter is taken up hearing the learned counsel for the appellant seeks permission of this court to withdraw this appeal and filed a memo to that effect.

2. In view of the memo filed on behalf of the appellant, this appeal is dismissed as settled out of Court. Further, the registry is directed to refund the Court fee paid by the appellant by deducting 5%. Accordingly, this appeal is dismissed as settled out of Court.
