This writ petition has been filed seeking a writ of mandamus directing the first respondent to fill up the 15% seats reserved for candidates selected by the Veterinary Council of India, the first respondent herein in entirety in respect of the Veterinary College or institute in the State of Tamil Nadu and Puducherry.
2. This writ petition has been filed contending that out of total number of 320 seats, 15% for Bachelor of Veterinary Science reserved for candidates selected by Veterinary Council of India which comes to 48 seats, whereas in the counseling only 30 seats were reserved and hence, there is a vacancy of 18 seats. Seeking to fill up the balance 18 seats, the present writ petition has been filed.
3. Learned counsel for the petitioner would contend that the petitioner has passed the requisite test and was placed under wait list. It is also the contention of the petitioner that if 15% seats were allotted as per quota, the petitioner would be benefited and hence, prays for allowing the writ petition.
4. Per contra, learned Special Government Pleader appearing for the respondents would submit that as per the list furnished showing the collegewise seats available as on 12.08.2016, two colleges i.e., Pondicherry University and Rajiv Gandhi Institute of Veterinary Educational & Research, were shown and for the said colleges 15% seats were allotted and hence, the relief sought for in this writ petition has become infructuous.
5. Heard both sides and perused the materials available on record.
6. Admittedly, as on date there are only two colleges in which seats are reserved in the 15% quota available. The petitioner has not submitted his application in any one of the colleges. In such circumstances, by recording the submission of the learned Additional Government Pleader, this writ petition is dismissed. However, it is open to the petitioner to submit his application seeking admission in the aforesaid colleges. Consequently, connected miscellaneous petition is closed.
