O R D E R

Heard the learned counsel for the petitioner and the learned Government Advocate appearing on behalf of the respondent and perused the records.

The petitioner by the present writ petition has assailed the action of District Revenue Officer, Nagapattinam in issuing proceedings dated 16.07.2019, whereby the representation/application of the petitioner dated 01.07.2019, by which the petitioner had sought for consideration of her absence from 23.11.2018 to 05.03.2019 as on duty, has been rejected.

The petitioner had claimed that by proceedings dated 23.11.2018, she was relieved from the post of Revenue Inspector, Kilvelur Unit and Taluk by the Sub Collector, Nagapattinam and thereafter, was appointed as Revenue Inspector, Thiruvilayattam Taluk Office vide proceedings dated 17.12.2018 and that her efforts to join at the newly posted place on 21.12.2018 having not been permitted, she had approached this Court by filing W.P.No.5407 of 2019 and this Court, by order dated 26.02.2019, having directed the respondent to permit her to join within six weeks and she having joined in service on 06.03.2019, the said period from the 2/6

date of her being relieved as Revenue Inspector, Kilvelur Unit and Taluk till her joining service as Revenue Inspector, Thiruvilayattam Taluk is to be considered as on duty, it is to be noted that the respondent by the counter affidavit had claimed that the petitioner was negligent in discharging her duties and for the said reason, she was relieved in the interest of administration vide proceedings dated 23.11.2018 and was not assigned any duties till the issuance of the proceedings dated 17.12.2018.

The respondent by the counter affidavit further contended that the petitioner, while working under the respondent, was assigned duties to attend Gaja Cyclone relief work, which she had failed to perform, and for the said reason, she was relieved from her duties by proceedings dated 23.11.2018 and was not assigned any official duties till the subsequent proceedings were issued.

Having regard to the stand taken by the respondent with regard to the petitioner not being assigned any duties, which claim of the respondent being denied by the petitioner, this Court is of the view that without expressing any opinion on the merits or otherwise of the respective claims of the petitioner as well as the respondent, since the impugned proceeding was issued by the District 3/6

Revenue Officer, who is not impleaded as party respondent to the present proceedings and the said proceeding being amenable to revision, the petitioner should be relegated to avail remedy of revision before the District Collector, Nagapattinam by filing a revision within 15 days from the date of receipt of a copy of this order or from the date of uploading the same on the website of this Court.

6. Upon the petitioner availing the remedy of revision within 15 days' time granted by this Court, as noted herein above, the respondent shall consider the same and dispose of the said revision in accordance with law as expeditiously as possible.

7. Subject to the above observations and directions, this writ petition is disposed of. Consequently, connected miscellaneous petition is closed. No order as to costs.
