This Petition has been filed to set aside the abatement caused due to the death of the fourth respondent in the above Second appeal in S.A.No.803 of 2011.

2. Heard the learned counsel for the petitioner and the learned counsel for the respondents and also perused the materials available on record.

3. On being satisfied with the averments stated in the affidavit filed in support of the petition and the submissions made by the learned counsels on both sides, this petition is allowed.
