This petition has been filed to enlarge the petitioner on bail in CC No. 455 of 2023 on the file of the Principal Special Judge Special Court under EC and NDPS Act in crime No. 84 of 2023 on the file of the respondent police.

2. The case of the prosecution is that the respondent police seized 205 kgs of Ganja from the accused. Hence, the case.

3. The learned counsel for the petitioner submits that the petitioner has been falsely implicated in this case as if he ran away from the scene of occurrence and also there is no material on the side of the prosecution to prove the petitioner's presence in the scene of occurrence. Hence, he prays to allow this petition.

4. The learned Government Advocate (Crl. side) submits that contraband seized from the petitioner is commercial quantity. Hence, he raised objection to grant bail.

5. Considering the facts and circumstances of the case and also the contraband seized from the petitioner is commercial quantity. Further, whether the petitioner was present in the scene of occurrence is a matter for trial. Accordingly, this petition is dismissed. Further, there is no progress in the Trial.
