This petition has been filed by the State seeking to condone the delay of 173 days in filing the above appeal.

2.Heard the learned Government Advocate (Crl. Side) appearing for petitioner/State.

3.The respondent filed his counter objecting for the condonation of delay for the reason that sanction for filing an appeal was obtained as early as in February, 2024, but the affidavit for condoning the delay has been sworn on 09.07.2024. Thereafter, with a delay of one month, i.e., on 09.08.2024, this petition has been filed. The petitioner has not given any proper reason or shown any diligence in prosecuting the appeal. Hence, strongly objected for condoning the delay.

4.Considering the objections and finding that the appeal is a procedural delay and it has been explained, this Court accepts the explanation. In view of the same, the delay stands condoned and the petition is ordered. 09.09.2024 rsi Note: Registry is directed to number the Criminal Appeal, if it is otherwise in order and post the same for Admission.
