JUDGMENT

(Judgment of the Court was delivered by R.Suresh Kumar J.) This intra court appeal has been directed against the order passed by the Writ Court dated 26.09.2023 in W.P.No.28012 of 2023.

2. The issue raised before the Writ Court was with regard to the regularisation of the services of the respondents / writ petitioners in the post of Forest Watchers, in which post they were appointed or initially engaged long years back. Since the issue is no more res integra as number of such incumbents have been regularised and their retiral benefits have been conferred by the Writ Court, the writ petitions were allowed by the impugned order.

3. Though against the said order the present writ appeal has been preferred, it is brought to our notice by the learned Government Advocate appearing for the appellants that the order of the Writ Court has been implemented by the issuance of G.O.No.22, Environment, Climate Change and Forests Department dated 26.09.2023 and by virtue of the said Government Order, the order of the Writ Court having been accepted and implemented, the pensionary benefits were extended to the respondents / writ petitioners

also.

4. This factor is not controverted by the learned counsel for the respondents / writ petitioners also.

5. In that view of the matter, nothing survives in this appeal for any fresh adjudication or to go into the correctness of the order passed by the Writ Court which is impugned order. The writ appeal is therefore dismissed. No costs. Consequently, connected miscellaneous petition is closed. (R.S.K.,J.)
