This application has been filed to grant leave to the applicants/plaintiffs to sue against the first and second respondents/first and second defendants in C.S.(Comm.Div)DR.No.71118 of 2022.
2. Being satisfied with the reasons given in the affidavit filed in support of this application, this Court is inclined to allow this application to leave to sue as a part of the cause of action has arisen in Chennai as has been averred in the plaint/suit that the plaintiffs have lent a sum of Rs.8,56,00,000/- (Rupees Eight Crore Fifty Six Lakhs only) to Late Pramod Naik (since deceased), the husband of the first defendant. The second defendant is currently residing outside Chennai.
3. It is further averred that the first defendant was also residing in Chennai and after the demise of her husband Late Pramod Naik, has relocated to Mumbai.

4. Considering the fact that a part of the cause of action has arisen within the jurisdiction of this Court and also considering the fact that two of the defendants are residing outside the Jurisdiction of this Court, this Court is inclined to allow this application to leave to sue. Accordingly, the above application is allowed.
5. Registry is directed to number the plaint/suit and if the plaint/suit papers are otherwise in order, suit and other applications if any may be numbered.
6. List the matter on 22.12.2022.
