COMMON PRAYER : Writ Petitions have been filed under Article 226 of the Constitution of India to issue a Writ of Mandamus, to direct the second respondent to consider the representation dated 30.06.2016 pending before the second respondent in relation to issue of patta in favour of petitioners for their registered residential property in survey No.228/2B1 to an extent of 990 Sq.ft. and 1040 Sq.ft. respectively at Nandivaram Village in Chengalpattu Taluk.

Government Pleader C O M M O N O R D E R These Writ Petitions have been filed to direct the respondents to consider the representation of the petitioners dated 30.06.2016 pending before the second respondent in relation to issue of patta in favour of petitioners for their registered residential property.

2. The petitioners have purchased residential property in survey No.228/2B1 to an extent of 990 Sq.ft. and 1040 Sq.ft. respectively at Nandivaram Village in Chengalpattu Taluk. While so, without verification of documents, the second respondent has wrongly issued patta in the name of the seventh respondent. Therefore, the petitioners have sent a representation to the first respondent on 30.06.2016. Since no action has been taken on the said representation, the present Writ Petitions have been filed.

3. The grievance of the petitioners is that when the applications of the petitioners are pending for grant of patta, patta has been granted in the name of the seventh respondent. The petitioners want to cancel the patta issued in the name of the seventh respondent and issue fresh patta in the name of the petitioners and for the said relief, the petitioners only have to prefer an appeal before the second respondent and these Writ petitions are not maintainable.

4. Accordingly, these Writ Petitions are dismissed. No costs.
