The petitioner who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 394 and 397 of IPC in Crime No.545 of 2022, seeks anticipatory bail. 2.The case of the prosecution is that the petitioner along with other accused trespassed into the medical shop of the defacto complainant and robbed an amount Rs.4,000/- and his mobile phone. Hence the complaint.

3.The learned counsel for the petitioner would submit that the petitioner is an innocent person and Due to previous enmity, the defacto complainant has given a false complaint against him. Hence, he prays for grant of anticipatory bail to the petitioner. 4.Per contra, the learned Government Advocate (Crl. Side) would submit that the petitioner is an habitual offender and that there are two previous cases similar in nature in Crime Nos.187 and 544 of 2022 https://www.mhc.tn.gov.in/judis

pending against the petitioner. Hence, he vehemently opposed for the grant of anticipatory bail to the petitioner. 5.Taking into account the nature of offence and the previous antecedents of the petitioner, this Court is not inclined to grant anticipatory bail to the petitioner. Accordingly, this Criminal Original Petition is dismissed.
