O.P.No. 813 of 2021 C.V.KARTHIKEYAN, J.

This Petition has been filed seeking grant of Letters of Administration with Will annexed relating to the Will dated 16.10.2008 executed by Tuppal Chellamma, who died on 24.09.2021. She died as a spinster. The petitioner is her sister. The respondents are the other class-II legal heirs. They had given their consent affidavits. During examination, the petitioner examined herself as PW-1. The Will dated 16.10.2008 was marked as Ex.P-4 and the death certificate of T.Chellamma was marked as Ex.P-5, the consent affidavit of the first to fourth respondents were marked as Exs. P-6 and P-9.

2. The petitioner also examined M.O.Veeraraghavan, as PW-2 and he was one of the attesting witness. He identified the said Will and he also stated that the testatrix signed the Will in his presence and in the present of S.Balachandar, stenographer. He also stated that the testatrix was in a sound and disposing state of mind. His affidavit was marked as Ex.P-13.

3. In view of the evidence produced, this Original Petition stands allowed as follows:- C.V.KARTHIKEYAN, J.

vsg (a) the letters of administration shall be issued in favour of the petitioner in respect of the properties mentioned in the petition. (b) The petitioner is directed to duly administer the said properties of the deceased.

(c) The petitioner is also directed to execute a security bond for a sum of Rs.25,000/- (Rupees twenty five thousand only) in favour of the Assistant Registrar (O.S-II), High Court, Madras. (d) The petitioner is further directed to render true and correct accounts once in a year.
