ORDER

The present criminal original petition has been filed seeking a direction to the respondents 1 and 2 to reopen the investigation in Crime No.610 of 2016 pending on the file of the second respondent and to re-investigate the same.

2. It is the case of the petitioner that his wife Tamilselvi was admitted at Archana Hospital, Tindivanam, for delivery and after diagnosing her, the fourth respondent informed him that the foetus was found dead and to save her life, an operation should be conducted. After operation, the foetus was removed and thereafter, without informing the petitioner, her wife was taken to Padmavathy Hospital, Puducherry, where the doctors refused to give treatment to his wife. Immediately, she was taken to JIPMER Hospital, where he was informed that his wife was brought dead. Hence, the petitioner lodged a complaint with the second respondent police. https://hcservices.ecourts.gov.in/hcservices/

On receipt of the said complaint, a case was registered in Crime No.610 of 2016. However, at the instigation of the respondents 3 and 4, the second respondent dropped the further action in the said case. Hence, the present petition.

Though the petitioner sought for a direction to the respondents 1 and 2 to reopen the investigation in Crime No.610 of 2016 on the file of the second respondent and to reinvestigate the same, at the time of arguments, learned counsel appearing for the petitioner submitted that now the petitioner confines his prayer for expeditious investigation in Crime No.610 of 2016 and file final report.

In view of the said submission made by the learned counsel appearing for the petitioner, the respondents 1 and 2 are directed to complete the investigation in Crime No.610 of 2016 and file final report as expeditious as possible, preferably, within a period of six weeks from the date of receipt of a copy of this order. The criminal original petition is disposed of accordingly.
