(Order of the court was made by the Hon'ble Chief Justice) This application is to condone the delay of 60 days in filing the appeal.

2. We are not satisfied with the explanation given for the delay. At the same time, as the delay is of only 60 days, as a special case, in the facts and circumstances, we condone the delay, subject to the applicants paying cost of Rs.10,000/- (Rupees Ten Thousand only) to the first respondent. The cost shall be paid by the officer concerned from his personal account within two weeks from today, within which period the compliance affidavit shall be filed. The affidavit shall be annexed with copy of the passbook showing the debit entry from the concerned officer's account. Copy of the affidavit shall also be provided to learned counsel for the first respondent.

3. If the cost is not so paid, the appeal SR shall stand dismissed without further reference to the Court. If the cost is paid, the Registry is directed to number the appeal, if it is otherwise found to be in order, and list for admission in due course.

4. The civil miscellaneous petition is ordered subject to compliance of the aforesaid condition.
